1. Acceptance

By joining the waitlist, creating an account or using the Service in any way, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and that you are legally able to enter into this agreement. If we learn that a user is under 18, we will close the account and delete its data.

3. The Service — and what it is not

Emma for the Girlies is a wellness companion: an AI you can talk to by text, voice note or photo; a journal; a mood tracker with energy levels and notes; daily affirmations; a weekly report that you can choose to include your conversations in; and a memory feature (“Add to Memory”) where you decide what Emma for the Girlies remembers and can view or delete those memories at any time.

Emma for the Girlies is not a therapist, psychologist, doctor, medical service, crisis line or emergency service. She does not diagnose, treat or prevent any condition, and nothing she says is medical, psychological, legal or financial advice. Emma for the Girlies is not a substitute for professional care. If you are struggling, please talk to a qualified professional.

If you are in danger or thinking about harming yourself or someone else, do not rely on Emma for the Girlies. Contact your local emergency services or a crisis line in your country immediately.

4. Accounts

To use the app you need an account. You agree to give us accurate information, to keep your login credentials confidential and to tell us right away at igotyou@emmaforthegirlies.com if you think someone else has accessed your account. You are responsible for everything that happens under your account until you tell us otherwise.

One person, one account. You may not share your account or transfer it to anyone else. You can delete your account at any time from within the app.

5. Acceptable use

Emma for the Girlies exists to support you. Use her kindly and lawfully. You agree not to:

• Use the Service to harm, harass, threaten, defame or exploit anyone, or to plan or encourage illegal activity.
• Upload content that is unlawful, that infringes someone else’s rights, or that you do not have the right to share (including photos or private information of other people without their consent).
• Attempt to break, overload, probe or bypass the security of the Service, or access data that is not yours.
• Reverse engineer, decompile, scrape or copy the Service, its models, prompts or underlying systems, or use automated tools to interact with it beyond normal personal use.
• Attempt to make Emma for the Girlies produce content that violates these Terms, or use the Service to build a competing product.

6. Your content and the licence you give us

Everything you share with Emma for the Girlies — messages, voice notes, photos, journal entries, moods, notes, memories — is your content. You own it.

So that we can run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to store, process, transmit, transcribe, analyse and display your content, including sending it to the third-party AI providers that generate Emma for the Girlies’ responses. We use this licence only to provide, secure and improve the Service as described in our Privacy Policy. The licence ends when you delete the content or your account, except for copies we must keep by law or that remain in backups for a limited period.

7. Intellectual property

The Service — including the Emma for the Girlies name and character, logos, design, text, software, prompts and all other materials, other than your content — belongs to Emma for the Girlies or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the app for your own non-commercial purposes in accordance with these Terms. No other rights are granted.

8. AI-generated content

Emma for the Girlies’ replies, affirmations, weekly reports and other outputs are generated by artificial intelligence. AI can be wrong, incomplete, out of date, or say things that sound confident but are inaccurate or inappropriate. Emma for the Girlies’ responses are not reviewed by a human before you see them.

Use your own judgement. Do not rely on Emma for the Girlies for decisions about your health, safety, relationships, finances or legal matters, and always verify important information with a qualified source. You are responsible for how you use what Emma for the Girlies says.

9. Third-party services

Emma for the Girlies relies on third-party providers, including large-language-model providers (currently OpenAI) to generate responses and hosting providers to run the Service. Your content is shared with those providers only to the extent needed to provide the Service, as explained in our Privacy Policy. We choose providers whose terms prohibit using your content to train their models.

Those providers have their own terms and are not controlled by us.

10. Termination

You can stop using the Service and delete your account at any time from within the app. Deleting your account permanently removes your content as described in our Privacy Policy.

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if continuing to provide the Service to you would create a risk for you, other users or us. We may also discontinue the Service or any part of it; where reasonably possible, we will give you advance notice so you can export or delete your content.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including about accuracy, reliability, availability, fitness for a particular purpose, or that the Service will be uninterrupted, error-free or secure. We do not guarantee any particular outcome for your wellbeing, mood or life from using Emma for the Girlies.

12. Limitation of liability

To the fullest extent permitted by law, Emma for the Girlies, its founders, employees and providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the Service — including decisions you make based on Emma for the Girlies’ responses — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for all claims related to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, if any, or fifty US dollars (USD 50).

Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.

13. Changes to these Terms

We may update these Terms as Emma for the Girlies evolves or as the law requires. We will post the new version with an updated date and, if the changes are significant, notify you by email or in the app before they take effect. If you keep using the Service after that, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

14. Governing law and disputes

These Terms are governed by the laws of Delaware, United States, without regard to its conflict-of-law rules. Any dispute that we cannot resolve together will be brought before the competent courts of Delaware, United States, unless the consumer protection law of the country where you live gives you the right to bring it elsewhere.

If any part of these Terms is found to be unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and Emma for the Girlies about the Service.
